Acceptance of Terms and Conditions of Sale

1.   Acceptance of Terms and Conditions

You agree to accept the Grubby Bubby® Terms and Conditions of Sale by submitting an order for a Grubby Bubby® product (Product) through our website.

2.   Returns and Refunds

Grubby Bubby® will accept a return of a Product and we will refund your money only when:

• You notify Grubby Bubby® verbally or in writing within seven (7) days after receipt of the Product that the Product is faulty, damaged or it does not properly fit your highchair;
• You provide your full name, delivery address, order number and any other details reasonably requested by Grubby Bubby® in order to validate the original purchase; and
• You return the Product to Grubby Bubby® within ten (10) days after delivery of the Product in an unused and resalable condition (subject to any defects or damage).

(Return Conditions)

If a return of a Product meets the Return Conditions (as determined by Grubby Bubby® in its absolute discretion), Grubby Bubby® will accept the return of the Product and refund your money in full including a refund of the original delivery postage costs that you paid on the original purchase of the Product.

If you are returning the Product to us the delivery costs for the return will be at your cost or, if the Product is faulty due to a manufacturing defect or is damaged, Grubby Bubby® will agree to refund to you the lesser of (i) your actual delivery costs; and (ii) an amount equivalent to the ordinary postage costs (from the original delivery address to Grubby Bubby in Brisbane, Australia), on the return of a Product.

Grubby Bubby® reserves the right to determine and notify you at any time whether or not the return of a Product satisfies the Return Conditions.

Grubby Bubby® will only accept and make a refund to you if the Return Conditions have been satisfied (as determined by Grubby Bubby® in its absolute discretion) and if you do not wish to accept an exchange.

3.   Exchange of Products

Grubby Bubby® will only agree to exchange a Product if :

• You made a wrong colour choice or if the Product is faulty or is otherwise damaged and you wish to exchange the Product rather than obtain a refund;
• You notify Grubby Bubby® verbally or in writing within seven (7) days after receipt of the Product that you made a wrong colour choice or that the Product is faulty or is otherwise damaged and you wish to exchange the Product rather than obtain a refund;
• You return the Product to Grubby Bubby® within fourteen (14) days after delivery of the Product in an unused and resalable condition (subject to any defects or damage); and
• Grubby Bubby® has received additional money from you to pay for delivery of the exchanged Product to your address if the exchange is due to a wrong colour choice.

(Exchange Conditions)

Delivery costs for the return and exchange of the Product will be at your cost or, if the Product is faulty due to a manufacturing defect or is damaged, Grubby Bubby® will agree to refund the lesser of (i) your actual delivery costs; and (ii) the equivalent amount to ordinary postage costs (from the original delivery address to Grubby Bubby® in Brisbane, Australia), on the return of a Product.

Grubby Bubby® reserves the right to determine and notify you at any time whether or not the return of a Product satisfies the Exchange Conditions.

Grubby Bubby® will only accept and make an exchange if the Exchange Conditions have been satisfied (as determined by Grubby Bubby® in its absolute discretion).

4.   Warranties and Implied Terms

To the extent permitted by law, all warranties and other implied terms are hereby expressly excluded and do not form part of these Terms and Conditions of Sale.

5.   Governing Law

The law of Queensland, Australia governs the contract between us and you and you agree to submit to the jurisdiction of Queensland if there is a dispute between us.

6.   Limitation of Liability

Subject to any obligations implied by law and which cannot be lawfully excluded, Grubby Bubby® is not liable to you for any losses, damages, liabilities, claims and expenses (including but not limited to legal, defence or settlement costs) whatsoever arising out of or referable to your use of our website, whether in contract, tort including negligence, statute or otherwise.

Grubby Bubby®‘s liability for a breach of a condition or warranty implied by law or otherwise, and which cannot be excluded, is limited to the extent possible, at Grubby Bubby®‘s election, to:

• the supply of the Product again;
• the repair of the Product; or
• the payment of the cost of having the Product supplied again or repaired.

Grubby Bubby® does not warrant the operation of the website or the server which stores and transmits the website is free from viruses or harmful components.

7.   Privacy

Grubby Bubby® will keep your personal information private and will only use your personal information for the purposes of doing business with you on our website and for our communications with you. Grubby Bubby® does not provide your personal information to any third party not related to Grubby Bubby®.

7.   Changes to these Terms and Conditions

Grubby Bubby® reserves the right to change these Terms and Conditions of Sale at any time. It is your responsibility to keep up to date with changes made to these Terms and Conditions of Sale.
